Motorcycle Accident and Injury Example
/43 year old father employed in the telephone sales field was traveling on his large and obvious Honda Goldwing Motorcycle with his seven year old son in the backseat, when a distracted young driver took a left hand turn right into him giving him a fractured left ankle, injuring his son and causing significant damage to the motorcycle. Through great skill, the rider was able to keep his bike upright and stopped and parked his bike even though he had a broken ankle.
The insurance company disputed liability, shockingly, claiming that the motorcycle must have been going fast or should have seen the young driver trying to make a left hand turn in a line of fairly slow moving traffic.
Eventually, the case settled for the $100,000 policy limit four days before the Plaintiff and his attorney were planning to pick a jury for trial. Subsequently, additional insurance coverage on the under-insured motorist policies held by the motorcyclist were available so that an additional $75,000 was recovered his behalf.
Total recovery $175,000. The rider had a good recovery from his broken ankle but continued to have periodic moderate pain on rainy days, etc. Maximum insurance coverage available was $200,000.
